1. Acceptance of Terms

By accessing or using the KeskTurg platform (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms apply to all users of the Platform, including Sellers (businesses listing products), Customers (individuals browsing and ordering), and Riders (delivery personnel).

2. Platform Role and Limitations

2.1 Communication Intermediary

KeskTurg operates as a neutral communication intermediary. Our role is limited to:

• Displaying store profiles and menus as provided by Sellers.
• Enabling messaging between Sellers, Customers, and Riders.
• Providing location-based discovery of nearby stores.

We do not verify, endorse, or guarantee any Seller, Customer, Rider, product, service, or transaction. Any interaction or transaction between users is entirely at their own risk.

2.2 No Obligation Between Parties

KeskTurg explicitly disclaims any and all obligations between:

• Sellers and Customers (including but not limited to order fulfillment, product quality, pricing, refunds, or disputes).
• Customers and Riders (including but not limited to delivery timing, handling of goods, or delivery disputes).
• Sellers and Riders (including but not limited to delivery arrangements, payment for delivery services, or liability for goods in transit).
• Any combination of the above parties.

Any agreements, arrangements, or understandings between users are independent of KeskTurg and are the sole responsibility of the parties involved.

2.3 No Agency Relationship

Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between KeskTurg and any user. Sellers and Riders are independent third parties, not employees, agents, or representatives of KeskTurg.

3. User Accounts and Registration

To access certain features of the Platform, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password and account credentials confidential.
• Be responsible for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct

You agree not to use the Platform to:

• Violate any applicable laws or regulations.
• Infringe upon the rights of others.
• Post false, misleading, or fraudulent information.
• Harass, threaten, or abuse other users.
• Distribute spam, malware, or other harmful content.
• Interfere with or disrupt the Platform's operation.
• Attempt to gain unauthorized access to the Platform or other users' accounts.

5. Seller Terms

Sellers who list products on the Platform agree that:

• All product listings, prices, descriptions, and images are accurate and not misleading.
• They have the legal right to sell all products listed.
• Products comply with all applicable food safety, health, and other regulations.
• They are solely responsible for order fulfillment, product quality, and customer satisfaction.
• They will handle all customer complaints, refunds, and disputes directly.
• KeskTurg has no liability for any product, transaction, or customer interaction.

6. Customer Terms

Customers using the Platform agree that:

• They place orders directly with Sellers, not with KeskTurg.
• Payment, delivery, and order fulfillment are handled directly between Customer and Seller (or Rider, if applicable).
• KeskTurg does not guarantee product quality, delivery times, or order accuracy.
• Any disputes regarding orders must be resolved directly with the Seller or Rider.
• They are responsible for verifying Seller credentials and product information before ordering.

7. Rider Terms

Riders using the Platform agree that:

• They provide delivery services independently, not as employees or agents of KeskTurg.
• They are solely responsible for the safe and timely delivery of goods.
• Any agreements for delivery services are made directly with Sellers or Customers.
• They bear all liability for their actions during the delivery process.
• KeskTurg has no obligation regarding rider compensation, safety, or working conditions.

8. Intellectual Property

The Platform, including its design, code, text, graphics, and logos (excluding user-submitted content), is owned by KeskTurg and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

By submitting content to the Platform (such as store profiles, menus, or images), you grant KeskTurg a non-exclusive, royalty-free license to display and distribute that content on the Platform for the purpose of operating the service.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, KESKTURG DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Merchantability, fitness for a particular purpose, and non-infringement.
• Accuracy, reliability, or completeness of any content on the Platform.
• Quality, safety, or legality of any products listed by Sellers.
• Availability, uptime, or error-free operation of the Platform.
• Any transaction, communication, or interaction between users.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KESKTURG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities.
• Personal injury, illness, or property damage related to any product or delivery.
• Any dispute, disagreement, or issue between Sellers, Customers, and/or Riders.
• Any action or inaction of any user of the Platform.
• Unauthorized access to or alteration of your data.

KeskTurg's total liability for any claim arising from use of the Platform shall not exceed the amount you paid to KeskTurg (if any) in the twelve (12) months preceding the claim, or $100 USD, whichever is less.

11. Indemnification

You agree to indemnify, defend, and hold harmless KeskTurg and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Platform.
• Your violation of these Terms.
• Any transaction, dispute, or interaction between you and another user.
• Your violation of any third-party rights or applicable laws.

12. Third-Party Services

The Platform may integrate with or link to third-party services (such as payment gateways, mapping services, or messaging platforms). We do not control and are not responsible for these third-party services. Your use of such services is at your own risk and subject to their respective terms and policies.

13. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

14. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KeskTurg operates. Any disputes arising from these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
